It's tough to start a small business. I've sat down with more clients then I can remember who were getting ready to take the plunge. Money is flowing, but in the wrong direction. Everyone that you encounter seems to think that you have this big pool of money (more like an oil geyser) that you can just go to and peel a little off for their ‘share’. And of course their share should be your top priority.

That being said, it’s difficult to practice law in this area and not be part of the problem but part of the solution. I try to be part of the solution. Many times the very documents that I have prepared for my clients at the beginning of their small business adventure prove to be the best money they have spent. However, I do understand that it’s hard to know if you should wait until you start making the money first or if you should set it up the right way from the start so that you are in a good position going forward. Tough call.

My first advice is to not fall prey to the cheap form document culture. The “I can go to Staples and get that done for less.” This is a fallacy. Your business is unique. Your situation is unique. The ‘fill in the blank’ forms might be better then nothing - but then again they just might be worse. It really is the old adage of ‘penny wise and pound foolish’ isn’t it?

At a minimum make an appointment and come and see me. I will give you the information that you need to know, what the questions are and, if you do decide to go forward with my legal services, how to answer them. But even to know what the questions are is a worthwhile proposal at this stage, primarily so you can avoid the many land mines.

I will do my best to keep your legal costs low at the beginning. If you get a strong foundation and succeed I will do fine in the long run. The important thing for both of us is that you have the knowledge to protect your interests.

Finally, don’t waste your money on a big firm at this early stage. When you walk into a big legal firms lobby it should remind you of walking into a casino lobby.
